7-Year-Old Assam Girl Forced to Live With Father against Her Wishes, Goes into Shock

Guwahati, October 6, 2019:

Well known Singer from Assam, Kalpana Patowary, has shared a video and questions if the word "guardian" solely implies to the birth parents. The video is of a little girl who had just lost her mother recently and does not want to go with her father, at any cost. She has been staying with her mother's family.

However, the Assam State Commission for protection of child rights had favored the father, as per law, he is the sole guardian of the minor child.

Patowary has questioned if there's any value of the emotions of the little girl and whether it is right to compel her to move in with her father.

Patowary took to Facebook and shared this video. She has called for strict action against Assam State Commission for Protection of Child Rights.

Patowary said, "The Chairperson of Assam State Commission for Protection of Child Right (ASCPCR) Dr Sunita Changkakoty, Rajeev Kr Jha, Technical Consultant ASCPCR and Dr Nilima Goswami of Child Welfare Committee (CWC), Kamrup (M) showed up their Cruelty to such an extent to this GIRL CHILD that she had to get admitted in Hospital. From last 2 nights she is in Trauma and screaming in shock ! We demand strict action to be taken against these authorities who are Misusing their powers!!"

The child's father was adamant to take her with him against her wishes, which has sent her into a state of shock.

Reacting to this incident, UTSAH founder Miguel Das Queah said, "The girl's mother died last month in Bangalore. The 7-month-old girl stayed in Assam with her mothers' family for a month, and refused to leave with her father. Then, the Assam State Commission for Protection of Child Right ordained that the child be 'rescued' from her mother's family. This incident has sent the child into trauma."

Miguel further added that the the Juvenile Justice Act clearly mentions that the best interest of child should be of paramount consideration, and that the child has the right to participate in matters affecting his/her life. "It was completely unlawful for the Chairperson of the Assam State Commission for the Protection of Child Rights to pressurize the Child Welfare Committee to give order for custody of the child to the father. The child clearly does not want to go to the father after her mother's sudden death. The CWC and the Commission violated the rights of the child by disregarding her opinion", he added.

The UTSAH founder further urged the Government to take action against the Chairperson of the Commission.
