Assam: Emergency nature cases to be listed for hearing only in Gauhati HC

Hon'ble the Chief Justice has been pleased to Issue the following guidelines, till further orders:-

  1. It is widely reported that COVID-19 Is transmitting through community. The number of COVID-19 positive cases is mushrooming day by day in the States of Assam, Nagaland and Arunachal Pradesh. It has been experienced In the last few weeks that even persons serving as Court staff and Judges, advocates have been affected by Coronavirus at the District Court level, and at the High Court level. It Is, therefore, evident that the circumstances have not changed since Notification No.48 dated 04.07.2020 was Issued. Rather, it has been reported that the conditions might worsen In the month of August.
  2. In view of the above, it has become administratively imperative to continue with the restrictions Imposed on Court working In the Principal Seat of Gauhati High Court at Guwahati, and In the Outlying Benches In Kohima (Nagaland) and Naharlagun (Arunachal Pradesh) as also the Subordinate Courts functioning under the administrative control of the Gauhati High Court at Guwahati in Assam and in the States of Nagaland and Arunachal Pradesh.
  3. In view of the above, it is hereby directed that only cases of emergent nature involving personal liberty, viz. bail matters, remand matters, habeas corpus petitions, recording of statement under Section 164 Cr.PC, Zimma Petitions and other matters Involving utmost urgency in which there is a genuine need for stay of some action, would be listed

    1. Filing of all cases, however, would be permitted In all Courts under the administrative control of Gauahti High Court.
    2. It is further directed that no person from "containment zones" or "quarantine areas" will enter any Court Complex under the administrative control of Gauahti High Court.
    3. These directions will be in force till 21.08.2020.
