Delhi Police Granted Emergency Detention Powers under National Security Act

New Delhi, January 18, 2020:

Delhi Police have been granted emergency detention powers under the National Security Act (NSA), 1980 starting from January 19, i.e. Sunday.

The Ministry of Home Affairs has issued an order granting the emergency detention powers to the Office of Delhi Police Commissioner, will will continue till April 18.

It may be mentioned here that under these powers, Delhi Police can detain any individual for months if they are convinced that s/he is a threat to national security and law and order.

The notification stated that in exercise of the powers conferred by sub-section (3) of section 3, read with clause (c) of Section 2 of the National Security Act, 1980, the Lt Governor pleased to direct that during the period January 19 to April 18, the Delhi Police Commissioner may also exercise the powers of detaining authority under sub-section (2) of the section 3 of the aforesaid Act.

The notification has been issued on January 10 following the approval of Lieutenant General Anil Baijal. It may be mentioned here that the notification has come at a time when majority of the people are continuing their protests against the Citizenship (Amendment) Act or CAA. The central government had recently issued an official notification implementing the CAA.

However, the Delhi Police said that the emergency detention powers is a routine order that has been issued in every quarter and has nothing to do with the current situation.
