IIT-Guwahati Rape: Prime accused gets bail

GUWAHATI: The Gauhati High Court has granted bail to the BTech student of the Indian Institute of Technology Guwahati (IIT-Guwahati)  who was accused of raping a fellow student of the same educational institute.

The accused student has been charge-sheeted under Sections 376/328/307/120B of the Indian Penal Code (IPC).

Hearing the accused student’s bail application, Justice Ajit Borthakur stated that there is a clear prima facie case as alleged against the petitioner based on all evidence.

The Gauhati HC called both the victim and the accused “the state’s future assets.”

“However, now that the investigation in the case is complete, and both the informant/victim girl and the accused are talented students pursuing technical courses at IIT- Guwahati, the state’s future assets, who are young in the age group of between 19-21 years only are being hailed from two different states, the continuation of detention of the accused in the interest of trial of the case, if charges are framed, may not be necessary,” the Court noted while granting him bail.

“After reviewing the list of witnesses cited in the charge-sheet, this Court concludes that there is no possibility of the accused tampering with their evidence or influencing them directly or indirectly if released on bail,” it added.

Accordingly, the accused was granted bail on a Rs 30,000 bond with two sureties by the high court.

The victim was allegedly raped on the night of March 28, 2021, by the accused on the school premises.

The accused student took the victim there under the guise of discussing her responsibilities as the Joint Secretary of the Finance and Economic Club of IIT-Guwahati students.

However, after making her unconscious by forcefully administering alcohol the accused allegedly raped her.

The victim girl was later rescued the next day and admitted to the Guwahati Medical College and Hospital (GMCH) Guwahati for forensic examination etc.

The accused was arrested on April 3.
